1. Agreement and eligibility
These terms are between you and Wave Link, LLC, at 24 Knowles Rd, Cataula, Georgia 31804-3908, United States, the operator of Hoyst (“Hoyst,” “we,” or “us”). They cover the Hoyst app, website, and related services. Wave Link, LLC is based in Georgia.
These terms govern your use of Hoyst. If you do not agree to the effective terms, do not use the service.
Hoyst is offered to people in the United States who are 18 or older and legally able to enter into this agreement. People under 18 may not use Hoyst. Use Hoyst lawfully and do not impersonate another person or create an account for someone else without authorization.
The Privacy Policy explains how information is processed. Optional device permissions and any legally required consents are separate from general acceptance of these terms.
To create an account, you must confirm that you are 18 or older and agree to these terms using the required signup checkbox. The signup screen also links to the Privacy Policy. This acknowledgment does not grant permission for unrelated advertising or marketing uses of your content.
2. Your account
Some features can be explored without an account. Creating commitments, joining Circles, saving activity, and other account features require sign-in. Provide accurate information, keep access to your sign-in method secure, and do not share credentials or verification codes.
You are responsible for activity you authorize through your account. Contact support@hoyst.app if you suspect unauthorized use. Hoyst may require verification before changing or restoring account access.
3. Commitments and progress
Hoyst provides tools for personal commitments, group accountability, Tap Ins, reminders, streaks, momentum, and progress. You choose your goals and remain responsible for deciding whether they are appropriate for you.
Hoyst is not a medical, mental-health, emergency, or professional advisory service. It does not diagnose conditions, supervise your activities, or guarantee safety or results. Do not rely on a reminder, nudge, progress score, or AI message for urgent help or decisions that require professional judgment.
Progress depends on schedules, timezones, stored activity, and the rules shown in the app. Partial entries, missed opportunities, skips, and restores may affect different measures differently. Reminders can be delayed or unavailable, including because of network conditions or device settings.
Hoyst is currently offered as a beta. Features can be limited, contain errors, or change as the product develops. We may correct erroneous progress, duplicate grants, or fraudulent records and will preserve any rights you have under applicable consumer law.
4. Your content and sharing
You keep ownership of the content you submit, including profile details, commitment descriptions, notes, messages, and photos. You must have the rights and permissions needed to provide it, including permission to share another person’s information or image.
You grant Hoyst a nonexclusive license to host, store, reproduce, display, transmit, and adapt your content only as reasonably needed to operate and maintain the service, follow your sharing choices, protect the service, and meet legal obligations. This includes technical changes such as image resizing and formatting. We do not use members’ posts or photos in Hoyst marketing, and this license does not grant a general right to use your content in advertising.
Profile information can be publicly accessible. Public Circles and their public activity summaries can be discoverable beyond their members. Members can see content shared within their Circle, and invitation links or exported content can be forwarded. Read the visibility section of the Privacy Policy before sharing information you consider sensitive.
Leaving or archiving a Circle does not erase your personal activity history; we retain it while your account remains active until you delete your account or remove the relevant information through a supported deletion option. Deleting your account can delete Circles you own and their shared content. Copies already saved or shared by others may remain outside Hoyst’s control.
The content license continues only to the extent needed for content still legitimately retained or shared within the service and ends when that content is deleted from our systems, subject to applicable legal and backup requirements.
5. Acceptable use
Use Hoyst respectfully and lawfully. Do not:
- Harass, threaten, impersonate, exploit, or abuse another person, or encourage dangerous or illegal activity.
- Share unlawful, sexually exploitative, infringing, or nonconsensual content, including another person’s private information without authority.
- Send spam, repeatedly misuse invitations or nudges, or use Circles to deceive or manipulate others.
- Attempt unauthorized access, defeat access controls, distribute malicious software, or interfere with the service.
- Manipulate XP, rewards, purchase verification, account records, or other users’ activity through fraud or unauthorized automation.
To report abusive content, an account problem, or an intellectual-property concern, email support@hoyst.app with enough detail for us to investigate. Do not include information you are not authorized to disclose.
We may investigate, remove or restrict content, or suspend access when reasonably necessary to address violations, security issues, or legal requirements. We do not promise to review every submission or prevent every harmful interaction. You can contact support to request review of an action affecting your account.
6. XP, rewards, and optional purchases
XP, levels, achievements, skips, and restores are app features. They are not money, investments, or a promise of financial return, and do not have a cash redemption value or a right of transfer outside the service.
Availability and use depend on the rules and eligibility shown in the app. A skip can protect an eligible Tap In opportunity; a restore can repair an eligible missed opportunity. Protection does not itself count as a successful Tap In or earn routine XP. Do not assume that every historical miss is eligible for repair.
Some reward features or purchase options may be unavailable during the beta or in your region. Where a purchase is offered, the native store will show the applicable product, price, and payment terms before you confirm. Store terms, refund procedures, and any mandatory consumer rights apply.
Purchases are associated with the Hoyst account used for verification. Delivery can be delayed while a transaction is pending or being verified. Duplicate or refunded transactions may be corrected, including unused rewards associated with a refunded transaction, subject to applicable law.
We may revise reward rules prospectively and explain material changes in the app or through another appropriate notice. Nothing in these terms removes a refund right or other protection that applicable law gives you.
7. Third-party services and AI
Hoyst uses services such as Firebase, OneSignal, app stores, and, where enabled, Google Gemini and RevenueCat. Sign-in providers, stores, email apps, and other services you choose may also have their own terms and policies. The Privacy Policy describes relevant information sharing.
Some Home greetings may be generated by AI from limited profile and commitment context. AI output can be inaccurate or unsuitable and should not be treated as verified advice. It does not change your actual Tap In records or create a professional relationship with Hoyst.
We do not control independent third-party services, but remain responsible for our own service and any obligations applicable law places on us.
8. App license and Hoyst ownership
Subject to these terms and the applicable store rules, you may use Hoyst for your own lawful purposes. Hoyst’s software, design, trademarks, and other original materials remain the property of their respective owners. Your content remains yours as described above.
Do not copy, resell, modify, or reverse-engineer the app except where applicable law or an applicable open-source license permits it.
For the iOS application, the Apple Standard End User License Agreement applies if no valid custom EULA is supplied with the release. The app license presented with your App Store download governs that license. These service terms supplement it and do not change Apple’s terms.
9. Ending your use
You can stop using Hoyst at any time. Uninstalling the app does not delete your account. Use Profile → Settings → Delete account to request in-app account deletion, or contact support if you cannot sign in. See the Privacy Policy for retention and deletion details.
We may suspend or end access for material violations, fraud, security risks, or legal requirements. Where appropriate and permitted, we will provide notice and an opportunity to address the issue. Urgent safety or legal matters may require immediate action.
We may discontinue a feature or the service. We will provide reasonable notice where practicable and handle any applicable rights relating to paid features under law. Provisions that by their nature must continue, such as ownership and applicable dispute provisions, survive termination.
10. Availability and responsibility
To the extent permitted by law, Hoyst is provided on an “as available” and “as is” basis. We do not promise uninterrupted availability, error-free calculations, permanent retention, or that the service will achieve a particular personal outcome.
Nothing in these terms excludes or limits rights or liability that cannot lawfully be excluded or limited, including applicable consumer guarantees and responsibility for fraud or other conduct for which the law does not permit a limitation.
11. Disputes, updates, and contact
If there is a problem, contact support@hoyst.app so we can try to resolve it. This does not prevent you from exercising any legal right or contacting a regulator or court.
Applicable United States federal and state law governs your rights and obligations. Nothing in these terms takes away mandatory protections available to you where you live or requires arbitration or an exclusive court location.
We may revise these terms. Material changes will be identified with an updated effective date and appropriate advance notice where required. If fresh agreement is required by law, we will obtain it. If you do not agree to the revised terms, you can stop using Hoyst and request deletion.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms do not transfer ownership of your content to us or waive rights that cannot legally be waived.
